Copyright License Agreement
The terms under which an accepted article is published in OnScientia — International Journal of Business, Law & Health. Authors keep their copyright; OnScientia receives the right to publish.
This Copyright License Agreement (the "Agreement") is entered into between the author or authors of an accepted manuscript and OnScientia Press LLC ("OnScientia"), publisher of OnScientia — International Journal of Business, Law & Health (the "Journal"); the registered address is stated in the Imprint. It sets out the rights the author keeps, the rights the author grants, and the assurances the author gives. It applies to the accepted manuscript and all of its content, including text, tables, figures, and any supplementary material (the "Article").
In this Agreement, "the Author" means the single author of the Article where there is one, and all co-authors jointly where there is more than one. Where the Article has one author, that author enters into this Agreement in person. Where the Article has more than one author, one of them is designated the corresponding Author and enters into this Agreement on behalf of all of them, as set out in Section 2. Obligations and assurances stated for the Author apply to each author of the Article.
1. Conclusion of This Agreement
This Agreement is concluded when the Article is accepted for publication. A single author confirms this Agreement personally through the submission portal; where there is more than one author, the corresponding Author confirms it through the portal on behalf of all authors. Confirmation is given before the Article proceeds to production. The Author's separate agreement to the Journal's submission terms remains in effect alongside this Agreement.
2. Single Author and Multiple Authors
Where the Article has a single author, that author enters into this Agreement for themselves and gives the assurances in Section 6 in their own name. Where the Article has more than one author, the corresponding Author enters into this Agreement for and on behalf of every author and confirms being authorized to do so; confirms that all authors have seen and approved the final accepted version and agree to be bound by this Agreement; and gives the assurances in Section 6 on behalf of all authors. In the multiple-author case the authors are bound jointly, and each author is responsible for the accuracy of the assurances as they relate to that author's contribution.
3. Copyright Stays With the Author
The Author retains copyright in the Article. Nothing in this Agreement transfers or assigns copyright to OnScientia. The Author remains free to use the Article for teaching, further research, and other scholarly and personal purposes, and to deposit the published version in a repository or on a personal or institutional website, consistent with the license in Section 4.
4. Open-Access License to the Public (CC BY 4.0)
The Article is published Open Access under the Creative Commons Attribution 4.0 International License (CC BY 4.0). Under that license, anyone may copy, distribute, adapt, and build upon the Article in any medium or format, including for commercial purposes, provided full attribution is given to the source. Full attribution means naming the author or authors, the title of the Article, the Journal, the year of publication, and the DOI, together with a link to the license and an indication of any changes made. Reuse without this attribution is not permitted by the license and remains an infringement. The Author grants this license to the public on publication, and it cannot be revoked once granted. The full terms are those published by Creative Commons at creativecommons.org/licenses/by/4.0/.
5. Rights Granted to OnScientia
To publish and sustain the Article, the Author grants OnScientia a worldwide, royalty-free license to:
- Publish first. be the first to publish the Article, and to make it permanently available Open Access under CC BY 4.0, with a registered DOI, as the version of record.
- Produce and sell editions. reproduce, distribute, and sell the Article as part of the Journal's compiled print and digital editions and related products, in any format and through any channel, now or in the future.
- Distribute and preserve. host, index, distribute, and archive the Article and its metadata for discovery and long-term preservation, and to make the technical adaptations needed to publish it (such as formatting and file conversion), without changing its scholarly content.
These rights are consistent with CC BY 4.0 and do not limit the Author's retained rights in Section 3. OnScientia is not obliged to publish the Article if, before publication, a breach of this Agreement or a matter under the Publication Ethics & Malpractice Statement comes to light.
6. The Author's Assurances
On acceptance, the Author confirms that each of the following is true:
- Original work. the Article is the Author's own original work and has not been published before, other than as a preprint disclosed and cited in the Article.
- Not committed elsewhere. the Article is not under consideration or accepted for publication elsewhere, and no rights in it have been granted to any other party that would conflict with this Agreement.
- Right to grant. the Author holds all rights needed to grant the licenses in this Agreement, and every person entitled to be credited as an Author is named.
- Third-party material. any third-party material reproduced in the Article is used with the necessary permission, and any table or figure based on a published source is the Author's own creation with reproduction rights confirmed, as required by the Author Guidelines.
- No infringement or unlawful content. the Article does not infringe any copyright, other intellectual-property right, or other right of any third party, and contains nothing unlawful, defamatory, or in breach of any duty of confidence or privacy.
- Integrity. the data, sources, and method are truthfully reported, and the Article complies with the Author Guidelines and the Publication Ethics & Malpractice Statement.
7. Breach, Liability, and Indemnity
If any assurance in Section 6 proves untrue, OnScientia may decline to publish the Article, or, where it is already published, correct or retract it under the Publication Ethics & Malpractice Statement. In that case the article processing charge covers the assessment and publishing work already carried out and is not refunded.
The Author will indemnify OnScientia against reasonable losses, damages, and costs that arise from the Author's breach of the assurances in Section 6, including a third-party claim that the Article infringes that party's rights. This obligation is limited to matters caused by the Author's own breach and applies only to the extent permitted by the law that governs the Author under Section 9; it does not extend to loss caused by OnScientia's own act or omission.
8. The Published Record
The published version is the version of record. Corrections and retractions, where needed, are handled under the Publication Ethics & Malpractice Statement and linked to the Article and its DOI. Because the CC BY license granted to the public on publication cannot be revoked, copies already distributed under it are not withdrawn by a later correction or retraction; the correction or retraction notice records the change to the record.
9. Governing Law
This Agreement is governed by the laws of the State of Florida, USA, and the parties submit to the courts of that State, except where mandatory law in the Author's country of residence requires otherwise. Where such mandatory law applies, it prevails only to the extent required, and the remainder of this Agreement continues in effect. If any provision is held unenforceable, the rest of the Agreement remains in force.
10. Entire Agreement
This Agreement, together with the Author Guidelines, the Peer Review Policy, the Publication Ethics & Malpractice Statement, the Terms of Use, the Privacy Policy, and the Journal's submission terms, is the entire agreement between the Author and OnScientia concerning the publication of the Article, and replaces any earlier understanding on that subject. Questions about this Agreement go to the editorial office through the Help Desk.
